Agreement
These terms govern your use of our website and the services provided by Immerse Vision UK (“we”, “us”, “our”). By using our website or engaging us to produce or host a virtual tour, you agree to these terms. If you do not agree, please do not use the site or our services. Specific projects may also be covered by a separate written quote or agreement, which will take precedence where there is any conflict.
Our services
We produce immersive 3D virtual tours and Matterport experiences and provide ongoing hosting of the delivered tours for businesses, universities, museums, cafés, offices and venues. The precise scope, deliverables and hosting arrangements for any project will be set out in the quote or order confirmation agreed with you.
Quotes and pricing
Pricing is agreed on a per-project basis. We will provide a quote based on the site, scope and deliverables you require. Unless stated otherwise, a quote is valid for a reasonable period and a booking is confirmed only once we have issued a written confirmation. Any charges, payment terms and applicable taxes will be set out in your quote or invoice.
Bookings and cancellation
Once a shoot is confirmed, we will agree a date for attending your site. If you need to reschedule or cancel, please give us as much notice as reasonably possible. Cancellations or changes made at short notice may incur a reasonable charge to cover time and costs already committed, as set out in your quote. We may also reschedule a shoot where access, safety or site conditions prevent us from carrying out the work, and will work with you to find a suitable alternative date.
Client responsibilities
You are responsible for providing safe and timely access to the site to be captured, for ensuring the space is ready and presentable, and for obtaining any permissions or consents needed for us to attend and record on the premises. Delays or additional visits caused by lack of access or readiness may result in additional charges.
Intellectual property and licence
We retain copyright and other intellectual property rights in the virtual tours, imagery and other media we create. On full payment, we grant you a non-exclusive, perpetual licence to use the delivered media to promote the business, premises or organisation it was created for, including on your own website and marketing channels. Unless we agree otherwise in writing, we may also display the work in our own portfolio, case studies and marketing.
Hosting
Where your project includes hosting, your virtual tour will be hosted for the period and on the terms set out in your quote or agreement. We aim to keep hosted tours available but cannot guarantee uninterrupted access, as availability may depend on third-party platforms and maintenance. Continued hosting after any initial period may be subject to a renewal arrangement agreed with you.
Limitation of liability
Nothing in these terms limits or excludes our liability where it would be unlawful to do so, including for death or personal injury caused by negligence or for fraud. Subject to that, our total liability arising out of or in connection with a project is limited to the amount you have paid us for that project, and we are not liable for indirect, consequential or incidental losses, or for loss of profit, revenue or data.
Governing law
These terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales.
